Phases of Probate Administration in California

Initial Petition
The initial filing with the court consists of identifying the heirs and assets of the estate and requesting the Court's authority to initiate administration.
The timeline for the initial hearing is between 2-4 months for appointment.

Estate Administration
After the appointment of an executor or administrator, the personal representative is responsible for collecting and marshaling the assets of the Estate. This includes selling houses or consolidating accounts.
This phase of the administration must remain open for a minimum of 4 months to identify any creditors or debtors of the estate.

Distribution
Once all assets have been collected and all debts addressed, the personal representative requests the court's permission to make distributions to the estate's heirs.
The Court requires a hearing on the requested distribution. This hearing is set between 2-4 months out (sometimes much longer).
Costs and Attorneys Fees
One of the main questions of the Probate Administration is, “How much is this going to cost?”
The Attorney Fees associated with the Administration are called Statutory Fees and is calculated on a percentage of the fair market value of the assets of the Estate. These fees can become very high; however, they do get paid at the end of the administration.
